Acceptance of Terms
By accessing or using the iSkool platform — whether as a school administrator, teacher, learner, or parent — you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform.
iSkool is a software product developed and operated by K2023260831 (South Africa) (Pty) Ltd (Registration No. 2023/260831/07), hereinafter referred to as "iSkool" or "we". These terms govern your use of the iSkool platform regardless of whether your institution is participating in the free pilot programme or is a paying subscriber.
Schools that enter into a pilot agreement or paid subscription with iSkool are also bound by the specific terms outlined in their agreement, which take precedence over these general terms in the event of any conflict.
Description of Service
iSkool is a cloud-based Learning Management System designed for South African high schools. The platform provides tools for running quizzes and assignments, tracking learner performance, managing the CAPS syllabus, communicating with learners and parents, and generating academic reports.
iSkool is provided as a Software-as-a-Service (SaaS) product and is accessed via a web browser without the need to install any software.
Accounts and Access
Schools are responsible for managing access to the iSkool platform within their institution. The school administrator is the primary account holder and is responsible for creating and managing teacher and learner accounts.
- Each user must have a unique login and must not share their credentials with anyone else.
- Schools are responsible for ensuring that all users within their institution comply with these Terms of Service.
- iSkool reserves the right to suspend or terminate any account that violates these terms.
Acceptable Use
You agree to use iSkool only for its intended educational purpose. You must not:
- Upload, share, or distribute any content that is unlawful, harmful, abusive, defamatory, obscene, or otherwise objectionable.
- Attempt to gain unauthorised access to any part of the platform, other users' accounts, or iSkool's servers and infrastructure.
- Use the platform to collect personal information about other users without authorisation.
- Reverse-engineer, decompile, or attempt to extract the source code of the iSkool platform.
- Attempt to circumvent the AI Invigilator or any other integrity monitoring feature during assessments.
The Free Pilot Programme
iSkool offers qualifying South African high schools a free pilot period, the duration of which is agreed upon in writing at the time of onboarding. During the pilot period, schools receive full access to the iSkool platform at no cost, with the same features available to paying subscribers.
- The pilot period is intended to allow schools to evaluate iSkool in a real classroom environment before making any financial commitment.
- iSkool reserves the right to conclude the pilot at any time with reasonable written notice to the school.
- At the end of the pilot period, the school may choose to transition to a paid subscription to continue using the platform.
- If a school does not subscribe after the pilot, their account will be deactivated. All school data will be retained for 12 months from the date of deactivation, during which the school may request an export of their data. After 12 months, all data will be permanently and irreversibly deleted.
- iSkool will notify the school by email at least 30 days before permanent deletion occurs.
Paying Clients
Schools that transition from the pilot programme to a paid subscription, or that onboard directly as paying clients, are governed by the following additional terms:
- Subscription fees, billing cycles, and payment terms are agreed upon in writing at the time of subscription and form part of the school's service agreement with iSkool.
- Subscriptions are invoiced in advance for the agreed period (monthly, termly, or annually as specified in the service agreement).
- iSkool reserves the right to suspend access to the platform if payment is not received within the agreed payment period. The school will be notified in writing before any suspension takes effect.
- Paying clients who wish to cancel their subscription must provide written notice as specified in their service agreement. Data will be retained for 12 months after subscription end, after which it will be permanently deleted.
- iSkool will not issue refunds for unused portions of a subscription period unless otherwise agreed in writing.
Intellectual Property
All content, design, code, features, and functionality of the iSkool platform are the exclusive intellectual property of K2023260831 (South Africa) (Pty) Ltd (Reg. No. 2023/260831/07) and are protected by applicable South African and international intellectual property laws.
Schools and users retain ownership of all content they upload to the platform, including questions, resources, and assignments. By uploading content, you grant iSkool a limited, non-exclusive licence to host and display that content solely for the purpose of providing the service to your institution.
AI Invigilator
The AI Invigilator feature monitors learner behaviour during live quiz sessions to protect academic integrity. It records events such as tab switching, browser exits, and focus loss. This data is accessible to the relevant teacher and school administrator.
Data and Privacy
Your use of iSkool is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using iSkool, you confirm that you have read and understood our Privacy Policy.
Service Availability
iSkool will make reasonable efforts to maintain platform availability. The platform is built and maintained to production standards, with capacity measures and monitoring in place to support uninterrupted use by schools.
During the pilot period and beyond, scheduled and unscheduled maintenance may occur from time to time. Schools will be notified of planned downtime where possible, with as much advance notice as is practical.
iSkool is not liable for any interruption to service caused by circumstances beyond our reasonable control, including but not limited to internet infrastructure failures, third-party hosting provider outages, or force majeure events.
Limitation of Liability
To the maximum extent permitted by South African law, K2023260831 (South Africa) (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform.
iSkool's total liability to any school or user for any claim arising out of or relating to these Terms shall not exceed the total fees paid by that school to iSkool in the three months preceding the claim. For pilot schools paying no fees, liability is limited to the maximum extent permitted by law.
Termination
iSkool reserves the right to suspend or terminate your access to the platform at any time if:
- You breach these Terms of Service.
- Your institution's subscription or pilot period expires without renewal.
- iSkool ceases operations.
Upon termination, you will lose access to the platform. Your data will be retained for 12 months from the date of termination, during which you may request a full export of your school's data by contacting support@iskool.online. After 12 months, all data will be permanently and irreversibly deleted. iSkool will notify the school by email at least 30 days before permanent deletion occurs.
Changes to These Terms
iSkool may update these Terms of Service from time to time. Schools will be notified of material changes via email at least 14 days before they take effect. Continued use of the platform after that date constitutes acceptance of the updated terms.
Governing Law
These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the jurisdiction of the South African courts.
